Over 200,000 Borrowers Now Eligible for Student Debt Cancellation

  • The Department of Education agreed to a $6 billion settlement to cancel the debt of 200,000 borrowers.
  • Borrowers will receive a full discharge of their loans, a refund and credit repair.
  • An additional 60,000 borrowers will have their cancellation decisions reviewed individually.

A federal judge last week granted preliminary approval for a class action lawsuit that will forgive student loan debt for about 200,000 borrowers, eliminating about $6 billion in total debt. More than 60,000 additional borrowers could also see their debt cancelled. Most of the schools involved are for-profit colleges or vocational training programs.

The settlement stems from a class action lawsuit in 2019, Sweet vs. Cardonawho argued that many borrower defense requests for loan cancellation were being ignored by the Department of Education.

Borrower Defense of Loan Repayment, often referred to as Borrower Defense for short, is a federal government program that allows you to pay off some or all of your student debt if your school has defrauded you or violated specific state laws, such as consumer protection laws. You must prove that you suffered specific financial harm as a result, such as not being employable as a result of your program.

How to know if you qualify

You don’t have to do anything to join the Sweet v. Cardona. You are a member if you submitted a Borrower Defense Request by June 22, 2022 and did not receive a decision or receive a denial form on or after December 2019. There is no cost to be part of the class action. , and borrowers from any listed school are eligible.

The class is made up of 264,000 people who have a pending borrower defense claim as of June 22, 2022 (the date the agreement was signed). About 200,000 have attended one of more than 150 schools listed below and will get a full discharge of their loans, a refund of what they paid, and credit repair. The Department of Education found significant indicators of misconduct by these schools and noted a high number of borrower defense applicants from these schools.

The other 64,000 students in the class attended schools not listed below. They will get individualized decisions on their borrower defense applications within rolling timelines, based on how long their applications are pending.

If you are a borrower whose school is not on the list, you may have to wait to get your forgiveness decision.


How to make a borrower defense request?

To request the defense of the borrower, you will need your Federal Student Aid ID number, name of school and program of study, dates of enrollment, and evidence to support why you think you are eligible for the federal defense. ‘borrower. You can apply online or by filling out a PDF and sending it by email or standard mail. The application process will take approximately 30 minutes.

There are a limited number of borrowers eligible for Borrower Defense, but it doesn’t hurt to apply and see if you’re eligible if you think your school has defrauded you.
